Privacy PolicyThis version of our Privacy Policy will take effect on 02 July 2020O.Vision is the trade name operated by O.Vision B.V. (the “O.Vision”), a legal entity duly incorporated and acting under the laws of the Netherlands. It provides a time & attendance tracking service and identity service, when we verify an identity or carry out checks related to an identity (the “Services”) through an online software application and website operated by Company (the “App”).

This Privacy Policy is meant to help you understand how we use the information we collect to provide our Services on behalf of our clients and build trust in our system.

For information about how your specific data is being collected and used, please review the privacy policy of our client who is using our Services with you.

We may need to update this Privacy Policy from time to time, so we recommend you check back periodically If we make any substantial changes, we may notify you via email or by posting a notice on our website.Any information we collect is subject to the privacy policy in effect at the time it is collected. By continuing to access or use our Ser-vices after any changes come into effect, you are agreeing to the revised policy.

The Information We Collect

To provide our Services, we need to collect certain information about our clients' users including personal data and, particularly, biometric information. “Biometric information” means any information, regardless of how it is captured, converted, stored, or shared, based on an individual’s biometric identifier used to identify an individual.

The exact information needed depends on the check that’s being carried out on behalf of our client.

In some cases, we may check whether we have previously verified a user on behalf of a specific client by comparing the picture of their face to the pictures previously provided by that client. This helps our client not only verify identity but further protects them and their users by helping them understand when a user may be generating multiple identities.

To do all of this, we closely examine the information contained in the images, including the machine readable data and the image metadata (such as the name of the camera model used to take the image).

Under no circumstances do we transfer your email address to any other company, nor do we collect any personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs.

The User

Users are individuals whose identities we verify or otherwise check on behalf of our clients. We collect users’ information from clients or directly from the users themselves. This information might include an image of the User, photos or a video of the User, and the biometric facial identifiers in those images. In some circumstances, we may also collect device identifiers and IP addresses to help us understand whether a device has previously been used in relation to suspected fraudulent activity and whether O.Vision is permitted to provide Services in the country in which the user is located. To further com-bat fraud, we also collect identity information that has been leaked or otherwise made available on the internet.

The User

This information might include an image of the User, photos or a video of the User, and the biometric facial identifiers in those images. In some circumstances, we may also collect device identifiers and IP addresses to help us understand whether a device has previously been used in relation to suspected fraudulent activity and whether O.Vision is permitted to provide Identity Services in the country in which the user is located. To further combat fraud, we also collect identity information that has been leaked or otherwise made available on the internet.

Data Providers

We also keep logs of how our clients, users, and data providers interact with our Services. This might include timestamps of when the information was submitted to O.Vision, and information about the device used to submit that information.

Sometimes, we receive information we don’t need to provide our Services. For example, instead of a picture of their face, a user might upload a completely unrelated image. When this happens, we seek to delete this data.

How we collect information from you

O.Vision collects the following personal information from you:

  • We collect biometric data through our facial recognition feature.
  • Name, address, telephone number, email address and payment information.
  • Communications with us e.g. comments, suggestions, a request for information about our products and services or any other correspondence or phone calls.
  • The way in which you use our services including in-App purchases.
  • Interactions with third-party service providers, marketing partners and affiliate interactions including.
  • We collect location based data (GPS coordinates) through our geolocation feature, if the Client has requested users to log in with their gps location.
  • We collect time entry and attendance data when you use the App.
  • Your Internet Protocol (IP) address (if using a browser), operating system, the browser type, the address of a referring site and any device identifier (if using a mobile device or tablet).

The lawful basis for collecting your data in this way is:

(a) You provide your consent at the point of registration for us to do so and by accepting our Terms & Conditions.

(b)Processing your data in the way explained above is necessary for us to provide O.Vision's services to users.

(c) Some of that data is processed for the purposes of our legitimate interests.

How We Use Your Information

O.Vision uses personal information to improve the quality of the services that we offer. Ways in which we may do this include by:

  • Collecting, storing, and usage of biometric data solely for employee/visitor identification, fraud prevention, and pre-employment hiring purposes.
  • Cross-referencing your information with that received from our partners in order to provide a more enhanced and personalized App experience.
  • Using the information you provide in our communications with you. For instance, in responding to your comments or inquiries, to resolve disputes, to contact you regarding any other operational issues with the App or matters involving product or service transactions, to address problems on the App or our Services and to enforce our agreements with you.

Facial Biometric Comparison

When providing our Services, we will frequently extract and compare numerical biometric data from facial images to understand whether two faces are likely to be a match.

Developing our Services

To further develop our Identity Services, we train our computers to recognize specific patterns in information and make predictions about new sets of information based on those patterns. This is known as machine learning.

Sharing Your Information

We will not share personal information about you with any third party unless we have your permission or under the following circumstances:

  • To facilitate the operation of the App and Services. For example and without limitation, maintenance services, database management, web analytics and improvement of the Service’s features or to assist us in analyzing how our App and Service is used. A third party here may have access to the personal information needed to perform their functions but it may not use it for other purposes.
  • We may share aggregated information that does not include personal information and we may otherwise disclose such information with third parties for industry analysis, demographic and analytical profiling and other purposes. Any aggregated information shared in these contexts will not contain your personal information.
  • We may sell, transfer or otherwise share some or all of our assets, which could include your personal information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of company liquidation.

Access To Your Information And Correction

You have the right to request a copy of the information that we hold about you.

  • Monitor aggregate usage by our users and web traffic routing on our App.

SecurityWe

We employ administrative, physical and electronic measures designed to protect your information from unauthorized access.

However, be aware that there are no security controls that are 100% impenetrable and thus there remains a small risk that data may be intercepted or misused.

Holding Information On Minors

The Services is not directed to minors and we do not knowingly collect personal information from them. Our Terms of Use state the Services can only be used by those who have reached the age of majority in the State and Province they reside.

If we learn that we have collected personal information of a minor then we will take steps to delete such information from our files as soon as possible.

Complaints

Our App contains links to other websites. Any information you provide on those sites is provided directly to the owner of that site and you should therefore, read their own privacy policies.
